最近有商場管理人員拒絕讓警方進入商場內執法。其實根據《警隊條例》第50(3) 條, 如任何警務人員有理由相信任何須予逮捕的人已進入或置身在某處，則居住在該處或管理該處的人在該警務人員提出要求時，須容許該警務人員自由進入該處，並給予一切合理的便利，以便他在內搜查。 根據《警隊條例》第63 條 如果任何人抗拒執行職責的警務人員或在被要求協助該執行職責的人員時拒絕協助，循簡易程序定罪後，可處罰款$5,000及監禁6個月。此外, 根據 《侵害人身罪條例》第36 條, 任何人 抗拒或故意阻撓在正當執行職務的任何警務人員或在協助該警務人員的人, 即屬犯可循簡易或公訴程序審訊的罪行，可處監禁2年。
Recently, certain property managers of shopping malls denied the entry of the Police officers to the premise(s) for the purpose of carrying out their policing duties. In fact, under section 50(3) of the Police Force Ordinance, if any Police officer has reason to believe that any person to be arrested has entered into or is in any place, the person residing in or in charge of such place shall on demand of that Police officer allow him free ingress thereto and afford all reasonable facilities for search therein. Under section 63 of the Police Force Ordinance, any person who resists any Police officer acting in the execution of his duty, or refuses to assist any such officer in the execution of his duty when called upon to do so, shall be liable on summary conviction to a fine of $5,000 and to imprisonment for 6 months. In addition, under section 36 of the Offences Against the Person Ordinance, any person who resists or willfully obstructs any Police officer in the due execution of his duty or any person acting in aid of such officer, shall be guilty of an offence triable either summarily or upon indictment, and shall be liable to imprisonment for 2 years.
